Welcome to TWS Magazine (“TWS,” “TWS Magazine,” “we,” “us,” or “our”). These Terms and Conditions govern your use of the TWS Magazine website, purchases, preorders, subscriptions, digital content, and print publications.
By accessing our website, placing an order, submitting a preorder, purchasing a subscription, or otherwise using our services, you agree to these Terms and Conditions.
1. AGE RESTRICTION
You must be at least18 years old, or the legal age of majority in your jurisdiction if higher, to access or purchase adult-oriented TWS Magazine content.
By accessing or purchasing age-restricted content, you represent that you satisfy the applicable age requirement.
2. TWS EDITIONS & ADULT CONTENT
TWS Magazine may publish multiple editions with different content standards.
TWS Gold Edition is intended as a non-nude edition and may feature models, entertainment, hip-hop, culture, celebrity news, gossip, sports, lifestyle, and related content.
TWS Diamond Edition is an adult-oriented publication that may contain nudity, sexually suggestive material, explicit language, and sexual themes. It is intended only for adults who meet the applicable age requirement.
Content and features may vary from issue to issue.
3. PREORDERS
Certain TWS Magazine products may be offered for purchase before their official publication or release date.
When purchasing a preorder, you understand that:
By submitting a preorder, you authorize TWS Magazine and its payment processor to collect payment according to the terms displayed at checkout.
Any cancellation or refund rights that cannot legally be limited by these Terms remain unaffected.
4. ORDERS TO CORRECTIONAL FACILITIES
Customers ordering TWS Magazine for someone housed in a correctional institution are responsible for verifying the receiving facility’s current publication and mail policies before ordering.
TWS Magazine does not guarantee that any particular correctional facility will accept any TWS publication, including Gold or Diamond editions.
The purchaser is responsible for providing complete and accurate recipient information required by the facility, including, where applicable:
Recipient’s legal name
Inmate/Resident ID number
Facility name
Facility mailing address
Housing information, if required
Rules concerning nudity, sexually explicit material, advertising, binding, publication format, sender requirements, and other content vary among correctional systems and individual facilities.
The description ofTWS Gold as “facility-friendly” does not constitute a guarantee of acceptance by any correctional institution.
5. REJECTED, RETURNED & UNDELIVERABLE PUBLICATIONS
TWS Magazine is not responsible for a facility’s decision to reject, confiscate, withhold, destroy, or return a publication because of that facility’s rules or policies.
Customers are responsible for ensuring that the recipient and mailing information supplied with an order is accurate.
If an order is returned to TWS Magazine, additional shipping or handling charges may apply before the publication can be reshipped.
Refund eligibility for returned or rejected publications will be determined according to our posted refund policy and applicable law.
6. PRICING & PAYMENT
Prices, shipping charges, promotions, and product availability are subject to change.
The price applicable to an order will generally be the price displayed when the customer completes the purchase, except where correction of an obvious pricing or technical error is permitted by applicable law.
Applicable taxes and shipping charges may be added during checkout.
7. SUBSCRIPTIONS
If TWS Magazine offers recurring subscriptions, the subscription’s price, billing frequency, included issues, and renewal terms will be disclosed when the customer subscribes.
By purchasing an automatically renewing subscription, you authorize recurring charges to your selected payment method until the subscription is canceled, subject to applicable law.
Customers may cancel future renewals according to the cancellation instructions provided by TWS Magazine.
Cancellation generally prevents future renewal charges and does not automatically refund issues or subscription periods already purchased, except where required by law or expressly stated otherwise.
8. REFUNDS & CANCELLATIONS
Except where otherwise stated at checkout or required by applicable law, completed purchases may be subject to TWS Magazine’s posted refund and cancellation policy.
Because print publications may be produced, allocated, or shipped specifically to fulfill customer orders, eligibility for cancellation or refund may depend on the order’s fulfillment status.
Nothing in these Terms eliminates any consumer right that cannot legally be waived.
9. USER RESPONSIBILITIES
TWS content is provided for lawful personal use unless TWS Magazine expressly authorizes another use.
You may not reproduce, republish, sell, distribute, upload, commercially exploit, or otherwise use TWS Magazine content without authorization from TWS Magazine or the applicable rights holder.
Adult-oriented TWS content must not knowingly be provided or displayed to minors.
10. INTELLECTUAL PROPERTY
TWS Magazine’s branding, logos, publication designs, and original content are owned by or licensed to TWS Magazine, as applicable.
Photographs, artwork, written material, trademarks, and other content may also be owned or licensed by their respective rights holders.
Nothing in these Terms grants customers ownership of TWS intellectual property merely because they purchased a physical or digital publication.
Unauthorized reproduction or commercial distribution is prohibited.
11. THIRD-PARTY SERVICES & LINKS
Our website may use or link to third-party platforms and services, including payment processors, ecommerce platforms, shipping providers, and external websites.
TWS Magazine is not responsible for the independent content, policies, security practices, availability, or actions of third-party websites or services, except to the extent required by applicable law.
12. PRIVACY
Information submitted to TWS Magazine will be handled according to our applicable Privacy Policy and legal obligations.
Customers purchasing publications for another person should only provide information reasonably necessary to fulfill the order.
13. PROHIBITED USES
You may not use TWS Magazine’s website or services to engage in unlawful or fraudulent activity, interfere with the operation or security of our systems, violate intellectual-property rights, impersonate another person, or harass, exploit, or harm others.
14. PRODUCT AVAILABILITY
TWS Magazine may limit quantities, discontinue editions, modify future publications, or cancel products that cannot reasonably be produced or fulfilled.
If TWS Magazine cancels a paid order that will not be fulfilled, the customer will receive any refund required under applicable law and the applicable payment/refund policy.
15. DISCLAIMER
TWS Magazine content and services are provided on an “as is” and “as available” basis to the extent permitted by law.
TWS Magazine does not guarantee that every publication will be accepted by every correctional institution or other recipient.
16. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, TWS Magazine will not be liable for indirect, incidental, special, or consequential damages resulting from the use of our website, publications, products, or services.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
17. GOVERNING LAW
These Terms and Conditions shall be governed by and construed in accordance with the laws of theState of New Hampshire, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.
18. CHANGES TO THESE TERMS
TWS Magazine may update these Terms and Conditions periodically.
When material changes are made, the updated version and effective date may be posted on our website. Continued use of our services following an update constitutes acceptance of the revised Terms to the extent permitted by law.
